Magazine limit upheld in Colorado

A federal judge on Thursday upheld Colorado’s new state law limiting the capacity of gun ammunition magazines, rejecting an effort by sheriffs and others to overturn the 2013 law.

U.S. District Chief Judge Marcia Krieger issued her 50-page ruling after a two-week civil trial in Denver.

The lawsuit was originally filed by plaintiffs including gun shops, outfitters and shooting ranges. Krieger ruled last year that the sheriffs could not sue the state in their official capacities but they could join the lawsuit as private citizens.

Colorado Attorney General John Suthers’ office represented defendant Gov. John Hickenlooper, who signed bills into law last year that expanded background checks and created ammunition magazine limits.

Defendants argued that legislators passed laws to increase public safety following mass shootings including the Columbine High School massacre in 1999 and the Aurora movie theater shootings in 2012.

The new legislation limited the size of ammunition magazines to 15 rounds.

Here’s my question for the judge, if “public safety” is protected by limiting magazines to 15 rounds, what’s to stop them from lowering the number to 10, 7, 1, even banning guns if they wanted to?

“Public safety” used to apply to viral diseases like tuberculosis and typhoid, when a home was quarantined to prevent others from getting infected. With guns there’s no such thing as public safety, only law-abiding individuals keeping themselves safe and free with their personal guns.
